Abstract (EN)

In Labor Law, apparently conscientious transactions, often performed by employers, are often intended to undermine the claims of internal and other creditors' claims and job security. Given that these collusive transactions are difficult to detect even in judicial decisions, it is an undeniable fact that the knowledge of workers and third parties will be inadequate to identify these issues. For this reason, with the investigations on who should claim and prove the collusive transactions by whom, the results of the provision of collusion transactions have found an area of examination. The aim of our thesis; the employers' loss of rights to workers or other creditors by which voluntary transactions or transactions similar to the transfer of the workplace, both doctrinal opinions and the evaluation of the results of these provisions within the framework of the decisions of the Supreme Court and employers, workers and other creditors.
