Abstract (EN)

In social security law, the element of foreignness arises when a worker in Turkey is a foreigner or when a Turkish citizen works in a foreign country. The principle of territoriality, a fundamental principle of social security law, requires individuals to be subject to the social security legislation of the country in which they work. The principle of territoriality continues to apply even when the employment relationship contains an element of foreignness, but given the exceptions provided for in international conventions and domestic legislation, employment relationships containing the element of foreignness result in differences in the scope of the social security rights that natural persons actually enjoy. However, a strong welfare state requires the expansion of social security rights to cover both foreigners and nationals, without discrimination. Limiting the rights to work and social security to citizens alone would adversely affect both the labor market and the overall social fabric. Thus, a welfare state must protect the social security rights of all workers regardless of nationality. The study will provide a comprehensive analysis of the work-related social security rights of foreign workers employed or working independently in Turkey, and Turkish nationals working overseas
