Administrative judiciary system and public auditing in Turkey

One of the important aspects of the Rule of Law is administration's being audited. Administrative authorities with supreme powers are always on a position to interfere citizens' rights by their administrative operations. In case such intervention took place there are some checking procedures which citizens can apply, but apart from judiciary inquiries almost there is none which can produce certain result available.Titled as "Administrative Judiciary System and Public Auditing in Turkey" this study analyzes the administrative judiciary system which carries out judiciary inspection of the administration and ombudsman system which has similarities in jurisdiction, authority and working method with the judiciary courts. After the very basics of the Turkish Administrative Judiciary System are given, Ombudsman System is broadly introduced. Examples from other countries' practices are given in order to reify apprehension of the system. The ombudsman system gained a constitutional status as Public Auditing Institution in Turkey but a legislative arrangements have not been laid yet for its operational function. Therefore, the foundation stage of the Turkish Ombudsman System is analyzed and similarities and differences between the ombudsman system and judiciary inspection are studied in the final chapter.
