Abstract (EN)

In the last half-century, our world has experienced significant industria development and an unprecedented technological transformation. This technological revolution has brought about a shift of crimes into cyberspace, creating unique cyber crimes. The fact that cyber crimes transcend national borders and citizenship has led to discrepancies in legislative actions and investigative and prosecutorial procedures, necessitating a common approach to the examination of such crimes. In our study, we examined 120 cyber crime investigations, corresponding to Articles 226, 243, and 244 of the Turkish Penal Code, which are subject to legal obligations under the "Budapest Convention" on combating cyber crime, to determine their alignment with legal frameworks. Using a scanning method in a comparative legal context, we analyzed these cases from a cybercriminological perspective. The findings highlighted potential areas for development in relation to the Convention, and recommendations were made based on effective methods employed by the United States, which is also a party to the Convention, for improving the fight against cyber crime
