The phenomena of cohabitation with the divorced (former) spouse and providing of false insurance in social insurances system in Turkey

Social security is a system which enables individuals to maintain their lives in accordance with human dignity and without dependence on other individuals. It compensates individuals and their dependents who are legally in their care against the loss of income and social risks they may encounter. Social security systems established by the state against the risks people may encounter are usually implemented by employing contributory and non-contributory schemes. Social insurance which is also called as the contributory system (regime) is a system established by the state, in which the participation is compulsory and the funding is provided by the contributions of the employees and the employers and in some circumstances by the inclusion of public resources as well. Social insurance (contributory regime) is the building block of social security system of Turkey, of which social assistance and social services (non-contributory regime) constitute a small part. Individuals who try to benefit excessively or unduly from the security provided by the social insurance system contribute negatively to the functioning of the system and cause loss of resources. This thesis tries to analyse in detail the subject of co-habitation with the divorced (former) spouse and false service claims with the aim of finding permanent solutions to the problems experienced in the light of Social Insurance and Universal Health Insurance Law No: 5510, which came into effect on 1st October 2008, together with its accompanying regulations.
