The role of international organizations in supporting and implementing international humanitarian law

Abstract (EN)

International humanitarian law (IHL) is one of the most important branches of international law developed to protect civilians and prisoners of war in situations of war and armed conflict, to limit the use of means and methods of warfare, and to safeguard human dignity. However, for this law to be effectively implemented, a normative framework established solely through state commitments is not sufficient; these norms must also be implemented in practice and on the ground. In this context, international organizations, as important actors in this process, play a critical role in ensuring, supporting, and disseminating the implementation of humanitarian law. Along with intergovernmental organizations such as the United Nations (UN) and the International Criminal Court, the International Committee of the Red Cross, the World Health Organization, and other non-governmental organizations undertake important roles such as protecting humanitarian law from violations, safeguarding refugee rights and combating war crimes, contributing to the normative framework, identifying and reporting violations, providing sanctions mechanisms, training and capacity-building activities, and engaging in mediation initiatives between parties. This study examines the functions of these international organizations in promoting and implementing IHL. Furthermore, this study analyzes the challenges faced by international organizations and the problems that limit their effectiveness, such as political interests, state sovereignty, resource inadequacies, and lack of international cooperation, and proposes several solutions for more effective implementation of international humanitarian law. The study demonstrates that international organizations, in particular, are indispensable in preventing violations, providing normative regulations, raising awareness, and operating accountability mechanisms, thus playing a complementary role in the implementation of IHL. Furthermore, it concludes that stronger global support and implementation of IHL is only possible with the active, sustained, and effective contributions of international organizations.
