Abstract (EN)
In this study, third party funding in international arbitration was examined. Firstly, since third party funding is a developing concept in the field of arbitration, its definition in national legislations and various international rules and regulations has been put forward. After that, the fund relationship was examined in terms of setting out the third-party funding process and a comparison was made with other types of financing. Since third party funding is not subject to any regulation in Turkish law, evaluations have been made in terms of Turkish law. In terms of the effects of third party funding on the arbitration proceedings, the conflict of interest situation and the current situation regarding the disclosure of third party financing have been revealed. Moreover, within the context of the impact of third-party funding on costs, the jurisdiction of arbitrators, as well as current decisions, has been discussed concerning both security for costs and the allocation of costs.
