Abstract (EN)
Building inspection is a process that aims to ensure the safety of life and property by controlling the project throughout the construction period. This process starts after the building permit is obtained and continues until the building occupancy permit is obtained. Turkey is largely a natural disaster area and natural disasters can have devastating consequences. Earthquakes cause loss of life and property due to damage or collapse of structures as a result of insufficient strength. After the earthquakes in 1999; In the Official Gazette on 13 July 2001, the Building Inspection Law and the Regulation on Procedures and Principles explaining the implementation of this Law were published in order to ensure the reliability of buildings and inspection according to the relevant legislation. Düzce province was also exposed to these earthquakes and suffered great destruction. In the Law related to this study; The changes made since the first publication were examined, and the justifications for these regulations were examined with the opinions of experts in the Ministry of Environment, Urbanization and Climate Change. In addition, with the help of a questionnaire applied to the building inspection institutions in Düzce, the technical personnel working there were asked to evaluate the relevant laws and regulations and the way they were implemented, accordingly the problems in the legislation were determined and solutions were tried to be developed. Finally; Administrative sanctions applied by the Building Inspection Working Units to the building inspection institutions in Düzce, which are found to have committed incomplete or faulty acts according to the provisions of the said Law and the legislation, were investigated. It has been tried to determine the density in the law, from which application and from whom. With this thesis, the reasons for the changes made in the Law on Building Inspection will be understood, the points that the building inspection institutions criticize in the relevant law and legislation will be determined, and the administrative sanctions applied to the building inspection organizations and those who are found not to fulfill their inspection duties will be linked to the actual implementation of the administrative sanctions in the Law, and in which subjects the mistakes made are most common. In addition, it is foreseen that the party with the most dominant responsibility in actual practice will be determined. As a result of the examination made in the process from the date of publication of the relevant Law to the present; It has been seen that the problems related to the "implementation of the law rather than its comprehensiveness" have come to the fore and every regulation has been aimed at facilitating the functioning of the law. In this context, necessary steps should be taken to ensure that the law is a necessity demanded by the society, rather than trying to be implemented as a mere text.
