Abstract (EN)
The experts play an active and important role in the proceedings. It is known that the reports they prepare can affect the judging process and court judgment significantly. It is expected that the concrete case from the experts will be able to understand the main key point of the dispute dispute, have specific and technical knowledge on the subject and demonstrate professional experience. In view of this effect of the experts, it is firstly necessary to have a clear understanding of the nature and history of the definition of the expert institution. It is realistic to make a positive or negative comment if it is known well which of the ways in the past and where the mold is seated. For this reason, in our work, primarily the definition, legal significance, history, and even the practices of other legal systems have been examined first. then general information was given about the implementation in our legal system. The responsibilities of the experts are emphasized in the light of all this information. The responsibilities of the experts in legal, criminal and professional sense have been revealed in case they fall into the wrong hands. The scope of responsibility has been dealt with as a result of the faulty and incomplete examination of the expert who was referred to the trial. In the continuation of the work, decisions made in accordance with the expert reports have been made by the high court. It has been tried to show that the reports of the Higher Health Council, which is the official official expert, and which was previously referred to as the official expert, can be ignored by universities and university-affiliated institutes in our courts, for example, where various hospital views are kept in front of other competent experts. In this study, the evaluation habits of the Supreme Court of Appeals, the decisions of the institutions of bilingualism and the problems of their operation will be examined and the importance of expertise competence and competences in High Judicial Decisions will be discussed.
