The Presidential System in terms of the transformation of the legislature

With the adoption of the Law No. 6771 Amending the Constitution of the Republic of Turkey by the popular vote on April 16, 2017 and the Presidential Cabinet formed on July 9, 2018, the government system of the Republic of Turkey became the Presidential Government System. With the abandonment of the tradition formed by the functioning of the parliamentary government system from the establishment of the Turkish Republic to that date, there have been radical changes in the functions and competence of the Turkish Grand National Assembly. In this study, the functions and competence of the Grand National Assembly of Turkey in the Presidential Government System are examined in comparison with the government systems in the context of the theory of separation of powers. The importance of a more effective and functional assembly in the system has been determined by evaluating the works and activities of the TGNA since the new system came into force. In line with this importance, suggestions have been presented regarding the formation of the assembly and its constitutional duties. The changes in the legislative, auditing, representation and negotiation functions of the TGNA were discussed as a result of the researches and the comparative analysis of the TGNA's roles before and after 2017 with positive and negative opinions about the role of the TGNA in the system. As a result of these changes, the justification of the criticisms directed at the system has been tested and suggestions have been put forward regarding the duties and authorities that the TGNA should be equipped with in order to make the Turkey's Presidiential System a more democratic system. Accordingly, some duties and powers of the TGNA should be increased and an election system in accordance with the Presidiential System should be put into practice.
