Abstract (EN)

This study examines bioethical issues within the framework of Islamic law, focusing on the principles of necessity (zarurat) and public interest (maslahah). It evaluates the ethical dimensions of modern biotechnological issues, particularly genetic interventions, and analyzes how Islamic law addresses such contemporary challenges. Our thesis begins by detailing the definition, historical development, and principles of the bioethics discipline, highlighting the intersections between bioethical principles—such as autonomy, non-maleficence, beneficence, and justice—and Islamic law. It also evaluates the relationship between Islamic law and bioethics in light of fundamental concepts like human dignity and the sanctity of human life. The thesis discusses the debates surrounding genetic interventions in the context of bioethics, analyzing them through the principles of necessity and public interest, and outlines the solutions Islamic law offers in such scenarios. In this regard, it emphasizes the critical role of necessity and public interest in resolving bioethical issues. Additionally, the thesis demonstrates how the dynamic structure of Islamic law provides a solution-oriented approach to bioethical issues, illustrating that modern scientific advancements can be addressed in harmony with ethical and religious perspectives.
