Abstract (EN)

Constitutional problem, which continues to this day despite efforts from the Republic of Turkey on this issue is a problem that cannot be solved somehow. The major steps taken in this regard are undoubtedly the 1961 and 1982 constitutions; however, these constitutions have made it more inescapable because of the fact that they were built during the periods of the coup or because of some other characteristics. The constitutions are not only legal texts and the constitution-making is not only legal, but also a political issue, as they play a very important role in shaping a society. Turkey's constitutional source of a kind of unsolvable problems does not lie in being incapable of writing a constitution for the country jurists of the country; the main reason is that the political actors in the country have not been able to make a constitution in accordance with the social structure of the country. In this study, a conceptual framework will be drawn from the concept of constitution and constitution making process. Then the construction processes of the 1961 and 1982 constitutions, the political developments that caused the military coups and the constitutionality of these constitutions and the structures of these constitutions will be examined and the reasons for these constitutions not to be long lasting will be determined. After the two constitutions are dealt with separately and evaluated and compared with each other, the findings will be compared with the 2017 constitutional amendment.
