Abstract (EN)

In order to evaluate the relation between legislature and executive in a system of government, it is required to check the authority of relevant branches and reciprocal distribution of these authorities. In the view of the fact that, in a system, concentration of power in any branch or any branch having more authority compared to the other branch would, without a doubt, disturb the balance of power between legislature and executive. Therefore, balancing the relation between legislature and executive is very crucial, in order to provide the checks and balances. In the first chapter of the study, theory of checks and balances, and systems of government based upon this theory will be examined with United States of America, France, and United Kingdom taken as example and the relation between legislature and executive in these countries will be examined. In the second chapter, the relation between legislature and executive in Ottoman-Turkish Constitutional History starting with 1876 Ottoman Basic Law will be analyzed. In the third chapter, constitutional amendments under date of 2007 and 2017, that include important changes regarding the system of government, characteristics of the government changed after these amendments, and relation between legislature and executive will be analyzed within this frame. In conclusion, this study analyzes the relation between legislature and executive in the system of governments based on the checks and balances and explains the relation between legislature and executive within the period from 1876 to these days, especially during 1982 Constitutional Era. In this point, this study benchmarks the new government system adopted with the constitutional amendment under the date of 2017. Keywords: Separation of Powers, Government System, Constitution.
