Purchase method with direct procurement in Public Procurement Act Number 4734

The tenders of public administrations in order to fulfill their needs were made under the Public Procurement Act 2886 which was enacted in 1983. This law which does not satisfy changing and developing needs and does not encompass all public institutions was replaced by a new and comprehensive Public Procurement Act 4734 which was coded in parallel with international procurement practices and European Union procurement procedures in terms of tendering arregements. Accordingly, the Turkish peblic procurement system has been harmonized with international practices, purchases become more transparent and accountable, and most significantly, the Public Procurement Authority, which is an institution that monitors purchases, has been formed. İn the first era that the Law No. 4734 come in to force, four tender methods were introduced. These tender methods are Open Tender Method, Restricted Tender Method, Negotiated Tender Method and Direct Tender Method. But, the Procurement Act has also been amended and direct tender method has been converted from a tender method to the purchase procedure with the amendment in 2003. The theme of our study constitutes purchase method with direct procurement. Descriptions concerning with tenders existing in the Public Pocurement Act 4734, the historical development of tender and procurement processes, the Public Procurement Authorrity and Public Procurement Act regulations will be discused in the first chapter. The Purchase Method with Direct Procurement will be addressed in all its aspects in the second chapter and an insight will be provided fort he problems encountered in procedure of the purchase method with direct procurements in conclusion.
