Abstract (EN)
In this study called Annual Paid Leave According to Labor Law No 4857, we tried to address the liberty of resting provided to the employee that worked under intense work tempo throughout a year as a paid annual leave in determined periods under certain forms in order to compensate for the bodily and spiritual exhaustion of the employee. Literature scanning, Labor Law no 4857 and the relevant regulations related to the subject and especially the effects of the new regulations that was brought by Labor Courts Law No 7036 to the annual paid leave right have been analyzed around the latest decisions of the Supreme Court as the analysis method in our study. Even though it was secured by the 1982 Constitution and the scope was determined by the law no 4857 and the relevant regulations, the annual paid leave right is exposed to violations due to the attitudes of the employers and the unconsciousness of the employees regarding the annual paid leave in our country. In this study, we tried to offer solutions to the problems seen in practice by analyzing these violations around the legal obligations.
