Abstract (EN)

This study aims to provide an overall evaluation of the effects of Insurance Law, dated June 14, 2007, no 5684, over the sector. It aims both to evaluate the extent to which the novelties brought by this certain law have been influential, found solutions to the pre-existing problems, and served needs of the sector and to state its deficiencies. In this study, definition of insurance along with its history and function is presented through a detailed literature review. In addition, the concept of risk is analysed in relation to the concept of insurance and the elements of insurance are explained through several decisions of Supreme Court. Previous and the new Turkish trade act have been compared while explaining concepts, institutions and organisations. Many problems existing before the law was put into force have been detected as a result of a detailed analysis. Moreover, the fact that these pre-existing problems have continued to be influential and the novelties brought by this law have not been as effective as expected was observed practically with questionnaires.This study aims to inform people and organisations interested in the insurance sector, to help insurance companies, insurance agencies that are important actors of the sector, and all other staff of the sector to get the highest productivity, and to lead people who will be a part of the sector in the future.
