Sales contract by installment as per scope of Turkish Code of Obligations with 6098 number and law on the protection of the consumer with 6502 number

Sales contract with installments is a type of sales for account that the sales subject is a credit sales type where the goods are delivered to the buyer without paying the sales price and the buyer is obliged to pay the sales price in at least two installments after receiving the goods. Today, it has a very big range of usage in markets. In this study, sales contract with installments was evaluated as per the perspectives of Turkish code of obligations with 6098 number and law on the protection of the consumer with 6502 number. Besides these two codes, Regulation on Sales Contracts by Installment, 764-766th articles of TMK with 4721 number and general provisions on sales contract were used. Our study has three sections. In first section, definition, elements, legal ground, application area, quality and difference of what compared to similar contracts of sales contract with installment were mentioned. Turkish code of obligations with 6098 number and law on the protection of the consumer with 6502 number do not have mutual grounds, which made having a general definition on contract and detection of application area of contract a lot harder. In second section, establishment of sales contract with installment were tried to be explained. In this section, parties, type, duration of contract and precautions for protection of buyer in sales contract with installment were mentioned. In third section, provisions of sales contract with installments were tried to be explained. In this section, after explaining general provisions of contract, right of buyer in case the buyer has a default of execution of debts for down payment and payments with installments, required conditions in order to use these rights, rights of buyer and contract on keeping property hidden were explained.
