The obligation of lessee to return the leased property under the Turkish Code of Obligations No. 6098

This study titled "The Obligation of Lessee to Return the Leased Property Under the Turkish Code of Obligations No. 6098" consists of five chapters: the introduction chapter, three main chapters, and a conclusion. The first chapter sets out the general framework for lease contracts, which is the legal ground for the lessee's duty to return the leased property and explores the termination of lease contracts. The second chapter begins with the definition and legal nature of the obligation to return the leased property; then explains the parties to the contract, the way in which the obligation is performed, place of performance, time of performance and the scope of the obligation to return the leased property. This chapter also involves special circumstances related to the lease contract as far as it concerns the obligation to return the leased property. In addition, this chapter analyses the agreements as to which the lessee undertakes to pay compensation to the lessor upon the termination of the contract and the validity of these agreements. The third chapter studies first the termination of the obligation to return the leased property due to the fulfilment and non-fulfilment of the contract, then the consequences of non-fulfilment of the obligation to return the leased property. The conclusion chapter summarises the results found in this thesis.
