Abstract (EN)
This study examines Law No. 6306, which is widely utilized within the scope of urban transformation practices in Turkey and used in executing a significant portion of urban transformation projects in practice. In terms of its legal framework, the said law regulates the transformation of areas under disaster risk and is approached as a comparative analysis on transformations aimed at implementing the Law. Within the scope of the thesis, the transformation of policies for areas under disaster risk over time has been examined legally, socially, and administrative perspectives.
This study was conducted within the framework of qualitative research methodology, utilizing document review and content analysis techniques. Legal texts and regulatory amendments were comparatively analyzed. In order to evaluate the practical functioning dimension rather than just the normative level of the implementation processes, the transformation application types and the scope of transformation for the 2012-2023 period and the 2024 period were examined. The findings reveal that the 2012-2023 period was characterized by individual applications based on risky building detection procedures and decision-making processes tied to land share majorities, demonstrating a fragmented and reactive nature. In the period after 2024, with the revisions made to the Law and the expansion of reserve building areas, it is observed that the implementations have moved towards a more planned and coordinated structure, are carried out through digital processes, the number of collective applications and ongoing projects has increased significantly, the implementation processes have accelerated, and it has evolved into a new policy model. The problems brought about by this evolution have been evaluated within the scope of this study.
Consequently, the 2012-2023 and post-2024 periods are conceptually coded as the “Deconcentrated Centralized Period” and “Concentrated Centralized Period," respectively. The “Mixed Participatory Transformation Model” (MPTM), which emphasizes public-led actual participation to balance structural tensions, is proposed.
