Supervision of the general assembly of the union within the scope of the Law on Unions and Collective Bargaining no. 6356

Trade unions are essential institutions that protect the rights and interests of workers in working life. Therefore, it is crucial that trade unions operate in line with their intended purposes. The general assembly, as the highest decision-making and supervisory body of a union, holds particular importance in this regard. Consequently, the supervision of this body has been subject to various legal regulations over time. This study examines the provisions of Article 15 of Law No. 6356 on Trade Unions and Collective Bargaining Agreements, considering scholarly opinions and decisions of the Court of Cassation (Yargıtay). The focus of this study is specifically on judicial supervision, which is what we refer to by the term "supervision" of the trade union general assembly.The study analyzes the content, scope, applicability, and effectiveness of the current judicial supervision over the general assembly of trade unions. It also aims to assess the adequacy of existing legal regulations in practice and to suggest potential improvements to enhance such supervision.
