Administrative sanctions up to new Electricity Market Law Numbered 6446

While the perception of the classic state has become changed with modernization, the tasks of the state have been also varied through this alteration process. The state does not only meet one's needs such as education, health and security; but also interferes in the economy part of the life actively such as market of money, credit, goods and service sector. Regarding those points, it can be said that the state regulates and supervises public and private activities within the fields in relation to economic rights; and applies sanctions getting rid of the deeds against law. This situation, which can be said also for our country, has come out with the process of privatization; and so that the "regulatory and supervisory state" (regulatory state) supersede the "entrepreneur state". Regarding aforementioned aims, Energy Market Regulatory Authority (Enerji Piyasası Düzenleme Kurumu/EPDK) was established as a regulatory and and supervisory authority in accordance with the (abolished) Electricity Market Law numbered 4628 which was came into force in 2001. EPDK performs its duties related to the the regulation and supervision of the energy market conducting following activities: licensing, tariffing, dispute resolution, guidance, deliver an opinion, applying sanctions. It is an undeniable fact that one of the more important authorities in this sense would be appling sanctions for actors in this market. As a matter of fact that many cases reached at the Council of State (Danıştay) in relation to administrative sanctions confirms this point. This study as regards the new Electricity Market Law dated 2013 and numbered 6446 covers the structure of EPDK, breaches in electricity market, and administrative sanctions for those breachs applied by EPDK. In this paper, the decisions of the Council of the State regarding to EPDK, and regulatory authorities in energy markets in some other countries in particular Canada have been examined in respect of illustrations.
