Pyramid sales contracts in accordance with the Law on the Protection of Consumers No. 6502

Pyramid sales contracts is arranged for the first time in Turkish legal system with the Law on Protection of Consumers No. 6502. The subject of our study is "Pyramid sales contracts in accordance with the law on the protection of consumers No. 6502". Pyramid sales contracts and the regulations relating to these contracts in the law on the protection of consumers No. 6502 constitutes the essence of our study. Pyramid sales contracts, in the most basic sense, states an unlawful sales system in which a small number of people earn a large amount of earnings due to the loss of earnings of a large number of people. In order to understand pyramid sales contracts better, the definition, subject, basic elements, parties, shape and types of these contracts and the establishment of such a contract are explained in detail. In addition, the comparison of legally operating network marketing system with pyramid sales contract is made and the legal nature of the conract is evaluated. The establishment, dissemination and recommendation of pyramid sales contracts is prohibited by an explicit provision of the law. Contracts made contrary to this provision shall be deemed to be contrary to the law. Therefore, the concept of violation of the law and the unlawfulness of the pyramid sales contracts have been examined in our study. Apart from this, the establishment, dissemination and recommendation of pyramid sales contracts have criminal dimensions. Indeed, the provision of the law states that the relevant provisions of the Turkish Penal Code will be applied to those who act contrary to this prohibition. The applicable provision of penal code is examined in our study in the light of the decisions of Court of Cassation. In addition to criminal sanction, the applicability of the general administrative violation provision on pyramid sales systems is also evaluated. Finally, the authority to make necessary examinations and take measures on pyramid sales systems of Ministry of Trade is specified.
