Abstract (EN)

The right to the protection of personal data has gained great importance in line with the increase in data breaches, with international regulations and the entry into force of the Law on the Protection of Personal Data No. 6698 in our law. In our study, the concept of "explicit consent", which is one of the reasons for the processing of personal data, the reasons for compliance with the law in the processing of personal data, and in particular, the law on the protection of personal data, within the framework of the Law on the Protection of Personal Data No. 6698, the European Union legislation and other international texts are discussed. There are four main parts in our study. In the first part; The concept of personal data, the emergence of the concept of personal data and the existing national and international regulations within the scope of protection of personal data are included. In the second part of our study; The concepts and basic principles that dominate the law on the protection of personal data are discussed. In the third part; Explicit consent, which is the reason for compliance with the law, and other reasons for processing personal data are explained in detail. In the fourth and last part, the validity conditions of express consent, how it can be obtained, the burden of proof in obtaining express consent and the capacity to give express consent are given.
