Protection of forest by criminal law under Law No. 6831

Due to the special value, they have, forests need to be considered separately from general regulations in many legal issues. Due to this need, the basic regulations regarding forests in Turkish Law were collected in a separate law under the name of Forest Law. In this Law, which includes various regulations on many issues from forest cadastral to the production of forest products, various types of crimes were also established for the protection of forests. In the first part of this study, forest law, which is a very comprehensive field of study, is introduced and related issues are briefly mentioned. As a matter of fact, understanding the types of crimes determined by the Forest Law requires contacting these issues. Throughout the study, the types of crimes that we call forest crimes are divided into four sub-titles and examined within the scope of crime theory. The criterion based on this title is the various elements of the forest in general. These elements are mostly harmed or in danger of being harmed by the relevant crime types. According to this, the tree, which is the main element of the forest, forest land, the forest property and the forest ecosystem, as a whole, constitute the relevant elements. In this context, in the second and third chapters of the study, forest crimes, which are quite complex in the Law, are systematically gathered and the points that pose problems within the scope of crime theory are tried to be clarified by making use of the relevant judicial decisions.
