Concerted practices of the financial sector in EU and Turkish competition law

Abstract (EN)

In this study, violations of concerted actions in the financial sector which restrict competition in the European Union and Turkey were examined. Any kind of confidential cooperation, parallel behavior and compromises that restrict competition and which do not reach the stage of agreement can be defined as concerted practice. Various examples of these violations in the financial sector were examined and we aimed to reach solution-oriented results. The reason why we have chosen the harmonious actions in the financial sector as the subject of our study is that it is a current issue where the European Union and Turkish competition authorities have imposed high fines on the undertakings in the financial sector in the recent years. This study consists of four parts. In the first part, the financial sector and competition regulations of the European Union were examined. In the second part, violations of concerted practices in the European Union financial sector were examined. Turkish competition law and the legislation regarding the financial sector were examined in the third chapter. The subject of the last chapter is the concerted practice violations in Turkish financial sector. In the conclusion part, we included the findings reached as a result of these examinations and the opinions which aim to find solutions to the problem.
