Abstract (EN)
In this Phd thesis, " "Legislative and Executive Relations in the US Presidential System and the Presidential Government System" were examined on constitutional grounds. The relations between the legislative, executive and judicial bodies are considered the basic criterion in the classification of government systems. In the presidential system, which adopts the rigid separation of powers theory, balance and control mechanisms are the basic elements in shaping the relationship between powers. With the referendum held on April 16, 2017, the parliamentary system in Turkey was ended and the Presidential government system was introduced. With the presidential government system, the structure of the executive body and the constitutional position of the head of state have changed. This change has led to the reshaping of the balance and control mechanisms that shape legislative and executive relations. This doctoral thesis was written in order to evaluate the balance and control mechanisms in the Presidential government system by comparing it with the prototype of the US presidential system, to respond to criticisms, and to suggest solutions if there are deficiencies in the system. In this context, this doctoral thesis consists of three parts. In the first part, the structure of the legislative body, the structure of the executive body and the relationship between the two powers in the United States presidential system are discussed. In the second part, legislative and executive relations in Turkish constitutions within the historical process are examined separately in the 1876 Constitution, the 1921 Constitution, the 1924 Constitution, the 1961 Constitution and the 1982 Constitution before 2017, respectively. In the last section, legislative and executive relations in the Presidential government system are examined.
