Abstract (EN)
The purpose of this study is to study and investigate a valuable scholarly manuscript, which is "Muhtasar Ma Fi Al-Rawda Wa Al-Minhaj" by the blind scholar Abd al-Malik bin Ali bin Abi al-Muna al-Babi al-Halabi (d. 839 AH). The scope of the study is determined from the beginning of the book of blood money to the end of the book of vows. The importance of this study comes from the author's scholarly standing, as he took from the great Shafi'i scholars, and was able to independently of his sheikhs with a special approach that he followed in his book. And his method was distinguished by good presentation and organization, so the jurisprudential chapters are divided into chapters, and the chapters are divided into branches and benefits, then he presents the sayings of the four Hanbali, Maliki and Hanafi jurists, and compares them with the sayings of the scholars of the Shafi'i school. This study used two copies of the manuscript in the Al-Azhar Library in Egypt. The study followed the historical descriptive approach when translating the author, presenting his biographical and scholarly biography, and the method of investigation and commentary in the edited text. The most important concluions of this study were: The idea of the book is based on listing issues that are not in Al-Rawdah and Al-Minhaj of Imam Al-Nawawi, so he used to start talking from these two originals, then complete the shortcomings from what came in other books, especially the urgent jurisprudential issues in his era: such as drinking hashish that came with the Tatars when they invaded Iraq and the Levant. Al-Babi Al- Halabi did not comment on issues except a little in what needed clarification. As for his sources, he used various sources, such as: Al-Umm by Al-Shafi'i, and the books of Imam Al-Nawawi in the Shafi'i school of thought - especially Sharh Sahih Muslim - and other books such as: Al-Hawi by Al-Mawardi, Sharh Al-Rafi'i, and Fatwas of Ibn Al-Salah, and Sharh Ibn Al-Mulqqin's Ala Al- Minhaj, and he quoted from books that are still in manuscript form, such as: Al-Basit wa-Waseet by Imam Al-Ghazali, and Al-Shamel by Ibn Al-Sabbagh, and some of them are rare or missing to this day, such as: Al-Taliqah by Imam Al-Baghawi. The book discussed delicate issues in the faith, such as: blasphemy of an ignorant of the attributes of God Almighty, and issues related to monotheism, pronouncement of testimony in Arabic and non-Arabic, and the rule of engaging in philosophy and the science of logic, and he distinguished between them. His book has reached a great importance, so that all the Shafi'i scholars who came after him relied on the book of the blind scholar, such as: Sheikh Al-Islam Zakariya Al-Ansari, Shihab Al-Din Al-Ramli and others. Keywords: Jurisprudence (Fiqh). Al-Babi Al-Halabi. Al-Rawda. Al-Minhaj. Blood Money. Vow.
