Özet (EN)

The ordinary partnership must expire with a reason in law or of the agreement. The expiration covers termination and dissolution. It is seen if it is looked in the Article 535 of Code of Obligations regulating the expiration of ordinary partnership.Dissolution is expiration of ordinary partnership on its own without the need for taking a decision or a process (notice) upon one of the reasons in law or of the partnership agreement that comes true.Termination is to terminate the partnership based on one of the reasons in law or in the partnership agreement by those who have this authority. In ordinary partnership?s expiration, either partners or the court is in this authority. Although the meanings of the concepts of dissolution and termination is different from each other, the result in both is the ending of the relation of the ordinary partnership. The relationship between the partners will be dissolved by the appearance of one of the reasons of expiration. However, the resolution of the relationship between the partners of the partnership doesn?t mean the end of the ordinary partnership entirely by disappearing. Because dissolution will just lead to the change of the partnership?s goal. The new aim of the partnership is liquidation of the ordinary partnership.Key Words: Ordinary Partnership, Code of Obligations, Termination, Dissolution, Expiration Reasons
