Abstract (EN)

The ordinary partnership contract is a contract in which two or more persons undertake to merge their labor and goods to achieve a common purpose. The ordinary partnership, which is frequently encountered in our everyday life, is one of the most complicated business relations and has been challenged in all areas of life. It has been organized between 620 and 645th article of the Turkish Code of Obligations and it has been decided that the Turkish partnership will be divided into three groups: "Representation" and "Representation Results" 637 and 638 of the Code of Obligations. When these provisions concerning the representative are examined, it is determined that the general provisions of the Turkish Code of Obligations apply if there are no special arrangements concerning the representatives of the third parties in the ordinary partnership. We have chosen this position in order to examine the issues related to the issue and to address the problems experienced in practice and to contribute to the solution in the name of the common partnership with its structure which allows the arrangements of the persons to be more easily arranged.
