Abstract (EN)

How the crimes against children are regulated in Afghan criminal law, what measures are taken against these crimes for the protection of children in Islamic law, and whether Afghan criminal law is in harmony with Islamic Law are among the issues that need to be examined. As a result of the evaluation of the crimes committed against children in Afghan criminal law and their analysis in terms of Islamic law, it has been determined that the rights of the child, which is the basis of the society, are taken care of in Afghan criminal law, that negligent acts committed against the rights of the child are considered as a crime, and that the protection of the rights and interests of the child is aimed with the implementation of the prescribed punishment for these acts. Islamic Law, the main source of Afghan criminal law, which has a long development process has taken protective measures to reduce the crimes committed against the child. Many of the sanctions established in Afghan criminal law for crimes committed against children are in harmony with the provisions of the "Hanafi furu" literature. This study consists of two chapters apart from the introduction; In the first chapter, information about the development and general structure of Afghan criminal law is given. In the second chapter, in Afghan criminal law, abortion of the fetus, employment of the child in the military, deprivation of the right of the child to education, training and health services, the beating of the child, the working of the child, the child being forced to give testimony or confession, the deprivation of care and regular feeding of the child, crimes such as sexual abuse of children and kidnapping of children in Afghan criminal law were addressed and evaluated in terms of Islamic law.
