Abstract (EN)

By the development of technology and globalization, now cross-border relations are readily available and intense. Indeed, no state do not live in their territory being introverted, relations of private law at the international level and especially in the field of foreign trade plays an important role in cross-border relations. Integration and interaction in social and cultural fields based on trade between different countries and work life, as well as development of technology, has led to an increase international private law relations relating to personal and family law between people who have different citizenships, languages, religions or cultures. As a natural consequence of these relationships, conflicts due to these relationships also increased. Judgments given as a result of these disputes in a foreign country court, give their effects outside of this country only with the legal institutions called the recognition and enforcement of foreign judgments. Recognition of foreign judgments relating to family law, were examined in detail within the framework of multilateral and bilateral international conventions to which Turkey is a party and Turkish Private International Law Act no.5718 called MOHUK (PILA), and consequently, the existence of a new recognition procedure might be called automatic recognition and accepted by bilateral and multilateral international conventions to which Turkey is a party, have been determined in private international law of Turkey.
