Abstract (EN)
The resolution of disputes through mediation is a preferred method in our country as it is a particularly amicable way of resolution and allows for sustainable relationships in the future. Family is the first and the most important place where children, who are the foundation of society and at the same time the future of society, grow, develop and acquire basic education about life. The effects of all positive or negative actions, events, words and behaviors that children are exposed to during this period can have repercussions throughout their lives. For this reason, it is very important that family relationships, which are the main concern of the Family Law, should be established and maintained in a healthy way. Research shows that divorce rates have increased in our country and in the world in recent years. Therefore, the number of children going through this process is also increasing. The resolution of disputes in the divorce and separation process through family mediation is successfully implemented in countries that apply this method. Although divorce and separation take place between married couples, the effects of the decisions taken during the process and at the end of it are of great importance for children both in the short and the long term. As the possible adverse effects of divorce on the child is so obvious, it is inevitable to consider the best interests of the child, to give importance to the feelings and thoughts of the child, to allow the child to express himself/herself, and to create a different approach for each child due to the unique characteristics of each child. At the same time, the benefits of involving the child actively or passively in this process and in the decisions taken in the agreement reached through mediation are very important in terms of the best interests of the child. Recently, some methods have been developed so that the implementation of family mediation can serve the best interests of the child more and there are still a lot of efforts put into developing more of such methods. For this reason, in our study, it is aimed to examine "family disputes" and "child focused mediation method in the resolution of family disputes", which is an effective method in the resolution of family disputes, and which will not harm the development of children and which is developed to protect the best interests of children. In the first chapter of our study, the concept of family dispute and that of family mediation are defined. In the second chapter, the judicial resolution of family disputes and the resolution of family disputes through mediation are discussed and some of the practices in other countries regarding the resolution of family disputes through mediation as well as the legal basis for the protection of children in family disputes are examined. In the third part, mediation methods for the protection of children in the resolution of family disputes are explained and the function and the functioning of the child focused mediation method in the resolution of family disputes, as well as the role of the mediator in this process are examined.
