The analysis of the opinions of İmams Shafi'i in 'Alaaddīn al-Samarqandī's Tuhfat al-Fuqaha

This study examines the authenticity of the opinions attributed to Imam al-Shafi'i (d. 204/820) in 'Ala al-Dīn al-Samarqandī's (d. 539/1144) Tuhfat al-Fuqahā. In this context, first of all, the opinions quoted in different ways in Tuhfat al-Fuqahā were identified and translated meticulously, and the sources of Shafi'i jurisprudence were consulted to determine the authenticity of the attribution of these opinions to Imam al-Shāfi'ī. As a result of this application, the opinions whose attribution was correct were explained, and the opinions whose attribution was found to be erroneous were justified and corrected. Our study, which we have written according to this method, consists of four chapters. In the first part, information about the importance, purpose, method, sources, and limitations of the study is given, as well as information about the life, teachers, students, and works of our author, Ala'ad-Dīn al-Samarqandī. Then, Tuhfat al-Fuqaha is evaluated in terms of content, method and style, and information about its sources and studies on it is given. In the second part, the topics of Tuhfat al-Fuqahā related to worship are discussed and 246 opinions attributed to Imam Shāfi'ī are analyzed. As a result of this examination, it was determined that 233 of these opinions were correct and 13 of them were erroneous. In the third chapter, 198 opinions on mu'amalāmā' were analyzed and it was noted that 187 of them were correct and 11 of them were erroneous. In the fourth and final section, a general evaluation of the research is made and the results obtained are explained in detail. As a result, as a result of the analysis we have done, we have determined and recorded that 420 of the 444 opinions attributed to Imam Shafi'i in Tuhfat al-Fuqaha (excluding repetitions) are correct and 24 of them are erroneous.
