Abstract (EN)

The aim of this study is to examine the extent and direction of the contribution of Mediation/Settlement, regulated under the Turkish Code of Criminal Procedure No. 5271, as an alternative dispute resolution method, to the legal system, specifically in terms of its impact on the new generation of justice approach in legal practice. Mediation, as one of the alternative resolution methods in criminal procedure law, aims to find a resolution between the victim and the accused through a neutral mediator based on voluntariness. This method facilitates the acceleration of court proceedings, the reduction of the judicial burden, and the resolution of disputes in a more humane manner between the parties involved. However, various suggestions for improving the effectiveness of mediation and ensuring its sustained productivity have been proposed. This study analyzes the issues arising in criminal investigations and prosecutions conducted by Public Prosecutor's Offices and Criminal Courts in Turkey between 2017 and 2024. It highlights the identification of problems related to case applications and proposes solutions, emphasizing the necessity of mediators and the need to increase the number of mediation cases.
