Individual application to the Constitutional Court

The Government is not only obliged with positive obligations to provide legal conditions to individuals in order to use fundamental rigts, it is also responsible to provide domestic legal instruments to offer an effective national and supra-national protection. Individual complaint is the one of the domestic remedies to protect individual rigts against governmental violations recently. After consitutinal amendment in 2010, individual complaint has became a domestic remedy in national legal system of Turkey. It is also recognised and recommended by European Court of Human Rigts. In this thesis, Constitutional complaint reviewed under five sections and given detailed information about the Turkish practice. It is also discussed that, individual complaint is an effective and efficient method to prevent violations and compensate damages.
