Abstract (EN)

A fundamental policy of the European Union (EU) has been the founded of an internal single market in which the free movement of goods, persons, services and capital is ensured. The Treaty on the Functioning of the European Union (TFEU) provides strong direction on how the single market should function and in particular, how the free movement of goods should be establish. The Court of Justice (CoJ – formerly known as the European Court of Justice) has backed the applications of the single market and the free movement of goods through its judgments. However, the difficulties of harmonizing member states with different cultures, regulations, and mindsets are abundant and challenging. The free movement of goods within the EU has generated a makeshift of EU legislation and case law. The study will try to find out the causes and the legal solutions regarding arbitrary discriminations or a disguised restriction on trade between member states and with the customs unions.
