The legal status of the refugees in the European Union

The rights all humans have without any discrimination which can not be abandoned or devolved to anyone are called human rights. As a human right, asylum right means quest for a protection of a person in the other countries when he can not or does not want to benefit from protection of his own country since he is afraid of being faced persecution with justifiable reasons due to his race, religion, citizenship, being member of a particular social group or political thoughts. A person who seeks for the protection of another state and whose application is accepted is defined as a refugee. Although the right of asylum refers to the need of living in consistence with human dignity, owing to states continual attitude it has been seen as a right created by states. In this case the right of asylum is perceived as a right granted by states instead of a fundamental right. The efforts of the European Union, which has 27 Member States currently, is still continuing to create a joint system between Member States about the asylum issue. However, when national sovereignty of states is under consideration, it is seen that to convey this adaptation to the desired level is not so simple. Turkey, in the frame of the negotiations carried on in the way of being a member of the EU, has to harmonize asylum issue according to the EU acquis. But the special geographical location of Turkey causes this matter to become to a state of complexity. In this study, harmonization of Turkey with the EU acquis which still keeps improving with the reactions it receives in the context of international law, results of harmonization and effects that will be brought 2 about with progress which will be achieved in the future in this issue will be analysed.
