Protection of fundamental rights in the European Union: An analysis of the charter of fundamental rights and its emergence process

In European integration, the process of the development of human rights is a significant historical experience that reveals the factors that the war-torn European countries had to consider as they were actualizing their development moves, the political ideals intended to be accomplished on the continent and the movements of cooperation among the states, the efforts of the actors that designate and play a role in the integration for preserving their authority as well as the extent to which their national dynamics had an influence on the efforts for building a supranational consensus. This process has paved the ways for the European Union Charter of Fundamental Rights, which is acknowledged as the most sophisticated catalogue of rights. The Charter, which has been influential on all conditions in which the Union has so far been dealing with starting from the Treaty of Lisbon, is a constitutional text from the perspective of the member states, which is binding as to their liabilities for the cases where they implement the Union law. In addition to the up-and-down progress of the integration process, as a result of which it came out, the occurrences that were encountered from its first drafting to the moment it became binding, have elevated this Charter to the status of being a case study and a model instrument for further pursuits of international consensus in the subject of human rights. In this study, the process of integration that generated the European Union Charter of Fundamental Rights will be analyzed with a focus on human rights and together with the contents of the Charter, its position in the European Union law will be attempted to be exposed.
