Transfer of undertakings in European Union and Turkish Law

One of the most fundamental and challenging issues of employment law is workers' acquired rights protection against transfer of undertakings or businesses. A business transfer is an establishment with a legal process while the economic entity retains its identity.We mentioned in our thesis, we discussed the subject in a systematic scientific. The aim of this thesis, which is the subject of Part I, is the transfer of business and undertakings, and the differences between them taken up and clarified. The concepts in Turkish Law and European Union Law was made in comparison with the origin of economic entity. The comparison has been made between these facts.Based on various legal processes can be achieved through transfer period. What is important here and disable of the transfer is legal ties between transferee and trasferor, over the net problem. In addition, the subject of trade partnership merger, division and also its involvement with such changes should be examined. Here is the second part of this work has been taken in the matters in question. In turn, in the same department that is protected under the provisions of business transfer "transfer" concept of the European Union and Turkey have been examined in comparative law.The third section of the thesis is devoted to the results of transfer of undertakings. In examining the results of the thesis, topic of period in parallel with the transfer of the employment law in terms of consequences were taken into consideration. In this context, first examined its effect on business relations business transfers and business contracts. In this section, especially employers who continue to take over contracts, labor contracts, and business integrity of the duration of the service focused on liability.
