In this study, the free movement of capital, which is one of the four freedoms of movement in European Union, is examined principally in light of relevant provisions of the Treaty on the Functioning of the European Union and decisions of the Court of Justice of the European Union.The provisions which were taking place in the first version of the Treaty establishing the European Economic Community and regulating the free movement of capital are written in a more flexible manner than the other provisions regulating freedom of movement. As a result, the free movement of capital was actualized later than the other freedoms of movement.Today these provisions are given place in 63-66. Articles of the Treaty on the Functioning of the European Union, Within the framework of the EU-Turkey partnership, the issue is given place in 19. and 20. Articles of Ankara Agreement and 50,51,52 Articles of Additional Protocol. under the title of "Economic Policy" which is the second Part of the third Section of the Protocol.KeyWords:1.
