İnvestigation and prosecution of lawyers for their crimes of duty

The profession of law has a long history and is considered one of the most important professions in human history. Lawyers carry out their duty to ensure the establishment of justice in society by defending the rights and freedoms of individuals. Due to the importance of this duty, there has been a need to make special regulations in many areas in the legal profession, unlike other professions. Special trial procedures different from general provisions have been adopted regarding the crimes committed during the performance of their duties. The special investigation and prosecution procedures brought about by Law No. 1136 on lawyers ensure that the independence of lawyers is protected during their duties and that they are prevented from facing unfounded accusations regarding matters related to their duties. Protecting the independence of lawyers, who are representatives of the defense, which is considered one of the founding elements of the judiciary, also results in the protection of judicial independence. Therefore, the fact that the legal profession is guaranteed means that the freedom to seek justice and the right to a fair trial introduced by the Constitution are also guaranteed.
