Determination of attorney's fee in the attorneyship contract

The subject of this study is the determination of the attorney's fee in the attorneyship contract. The important amount of provisions in the Attorneys' Act is about the attorney's fee. Between Article 163 and 174 of Attorneys' Act, there are provisions about the determination of the attorney's fee by parties and judge and special sides of the attorney's fee. The term of attorney's fee includes the fee which is decided by courts as a litigation expense. In our study, the legal character of attorneyship contract has been determined. Then, the provisions of the Attorneys' Act and other acts which limits the parties and judge about determination attorney's fee have been analysed. Finally, the special sides of attorney's fee like a fee in the constitution, joint liability from attorney's fee, and the effect of withdrawal and resignation to the attorney's fee debt have been analysed.
