Allocation concept in et-Taqrîb ve'l-Irshâd by Bâqillânî

Our thesis examines concept of the allocation (takhsees) in the axis of ?et-Taqrîb ve?l-İrshâd es-Sakhîr? by Baqillani. In the history of methodology of Islamic law, Baqillani, after Shafii, is a thinker that deepens and systematizes the method of theologian (mutekellim). Therefore, he has got serious effect on the methodologian of Islamic law. Our thesis analyzes concepts of amm (general), hass (specific) and muhassis (allocating). These words determine allocation theory of Baqillani. This work analyzes debates, in terms of Baqillani, between different school about meaning attributed to concepts.Our thesis is composed of an introduction and three chapters. In the introduction we discussed the extent and method of our study. We gave short information about Baqillani and his writing et-Taqrib that it is subject of our study.In the First Chapter, the concept of general (amm) is examined. This chapter introduced that Baqillani defined the concept of general as a word include two or more things within range of clause meaning, Which includes general close among these things and which doesn?t include, just come on the scene by presumption.In The Second Chapter allocation subject is debated. This chapter introduced that according to Baqillani allocation is a declaration of intent. Talkers declare the things include the clause and the things don?t by allocation.In the Third Chapter the allocating (mukhassis) evidence are investigated. This chapter introduced that Bâkillânî separate the allocating evidence into two parts. First of them connected (muttasil) evidence such as istisna (exception) and shart (condition). They are understood from constructer of sentences. The Second of them are separated (munfasil) evidence. They are independent from sentences such as reason, sunna, icma and qıyasKey words: Baqillani, Âmm (general), Hâss (specific), Tahsîs (allocation) Muhassis (allocating), Teâruz (antinomy).
