Abstract (EN)

Developments in the payment with card sector provided so many advantages to it?s customers as well as providing a convenient environment for crime and criminality with it?s security vulnerability. That?s why illegal acts that are commited by debit and credit cards which are a part of the daliy life should be punished by the rules of criminal law.When Turkish Criminal Code no. 5237 was enacted, crime of misuse of credit and bank cards was regulated under computer crimes section of the code. The legislator regultes this crime privately in order to end the discussion during the effect of the criminal code no.765 concerning if this crime is a computer crime or a crime against property. In this thesis first topic discussed is the concept of computer crimes and the work aims to analyse this crime within the scope of computer crimes. Afterwards general information was given about the operation of payment card systems and definition, features also usage (ATM, POS , Internet banking etc.) of the elements of these systems debit and credit cards.The regulation in art. 245 of the Turkish Criminal Code includes several crimes. First paragraph regulates misuse of the debit and credit cards, second paragraph regulates production of counterfeit cards and trading these cards, third paragraph regulates benefitting by using counterfeit cards. These crimes were discussed under seperate titles. Controversial issues are tried to be solved by regarding court decisions and doctrinal opinions.
