Criminal responsibility of the head of state in Presidential systems and Turkish law

In this Phd thesis, criminal responsibility of the head of state in presidential systems and turkish law has been examined. The structure of the executive branch and the position of the head of state have also changed in parallel with the Presidential government system adopted by the Law No. 6771 on the Amendment to the Constitution, which was adopted with a referendum on 6 April 2017. For this reason, in accordance with our new government system, the criminal responsibility of the head of state has also been re-arranged in our Constitution. This doctoral thesis has been written in order to be able to commantate the constitutional provision regarding the "President's criminal responsibility", to respond to criticisms and to make suggestions if there are deficiencies. In this context, this doctoral thesis consists of three parts. In the first part, firstly the position of the head of state in state systems and government systems, and then the responsibility of the head of state in government systems is examined. In the second part, the criminal liability of president in presidential systems is examined separately by making a comparative law analysis. In the last part, the criminal responsibility of the president in the presidential government system has been examined by comparing it with the countries we have examined in the second part.
