The impairment of will caused by brain-computer interfaces in users and its impact on contracts

In the first chapter of the study, following theoretical information about brain computer interface technology, the theory of neuro-rights and the ethical and security issues arising from such interfaces are discussed. This section aims to provide the technical foundation for the analyses carried out in later chapters and to demonstrate that the risks considered in this study are not hypothetical but represent real concerns. In the second chapter, the declaration of intent as a constitutive element of a contract and the nature of intent transmitted via the interface are addressed. The role of the interface as a medium for conveying intent is examined, followed by an assessment of the conditions for a contract's validity. In the third chapter, the effects of defects of consent and exploitation on the contract are examined. Within this framework, the validity of contracts concluded under the influence of such conditions and their impact on the parties' liability for damages are analyzed.
