Abstract (EN)
Science and art are one of the effective methods of expressing ideas. Therefore, while scientific and artistic activities are sharing issues of public interests that are no one dares to say, they are exposed to pressure and limiting of states, administrations and various ideological groups since first appearance. For science and art to deal with all these pressure and limitations, science and art are protected independently with freedom of science and art of freedom of expression in modern constitutions. In this study, it is primarily tried to determine conditions for a work to have a scientific and artistic quality. After that, the topic of legal nature and scope of science and art, their relations with constitutions, administration and criminal law and limitation of freedom of science and art are examined. During study, our domestic law, international law regulations especially European Convention on Human Rights and in comparative law, regulations of freedom of science and art of all countries and the USA in particular have been considered. As a result of all the investigations and discussions it has been reached that, to call a work a scientific or artistic work, it has to have some qualifications, however, these works could benefit from the protection of freedom of science and art in particular, freedom of science and art needs greater and special protection than freedom of expression and, science and art should not be restricted by state and non-state organs unless they intervene in fundamentals rights and freedoms.
