Duties, authorities and effectiveness of the municipal council as a law enforcement: Case of Gaziantep Metropolitan Municipality

Municipality police, which has an important role in implementing the local government policies and accessibility of the services efficiently and on time, are the law enforcement officers keeping the order of the town, protecting the welfare, health and peace of the public and implement the decisions taken by the authorized bodies of these purposes. The municipality officer, which is inspection and control mechanism, has a lot of things to do with the solving problems that arises from the interaction between local government agencies and the society. Starting with the Regulation of Municipality Officers, the municipal police carrying out the related duties given by the relevant legislation are faced with uncertainties arising from their duties, powers, and responsibilities, apart from their expectations for improvement in their personal rights. These uncertainties often ends up with the lawsuits of business and transactions and causes them to be stopped by the court decision. Providing the municipality police with effective control mechanism is possible through consolidating the legal basis of their duties, responsibilities, and clearly defined boundaries of the organization. Throughout this thesis, the problems popping up at the stage of performing a duty on time and efficiently by the municipal police, and the possible solutions are examined with the lights of scientific data. For this purpose, the findings have been obtained that it is necessary to improve the municipal services to teach a higher quality, effective and sustainable standards. First section the thesis focuses on the municipal organization and law enforcement agency and the municipal bodies and establishments have been investigated. Second section focuses on the municipality police organization and its duties, history, authorities and responsibilities, appointments and personal rights with a comparison to that of the other countries. The third section put emphasis on the problems and potential solutions of the Gaziantep Metropolitan Municipality police in terms of their duty, authority and responsibility.
