New normal working model in individual labor law: Working at home

Working from home is a contemporary work model wherein the employee's residence serves as an alternative workplace, distinct from the conventional office setting. Within the literature, the concept of working from home is positioned as a subset of remote work. Turkish legal frameworks acknowledge this form of employment through the incorporation of the home service contract in the Turkish Code of Obligations, as well as the regulation of remote work within the Labor Law. The concept of working from home has been designated in this thesis as a new normal work arrangement. The rationale behind this designation lies in the ability of modern work conditions to allow work to be conducted from home without the need for physical presence at the workplace. Within our country, a technological communication infrastructure supporting remote work is prevalent in nearly all large-scale workplaces. In recent times, there has been a notable increase in the implementation of the working from home model, and it is predicted that its prevalence will continue to grow in the near future. Recent global events such as viral outbreaks and natural disasters like earthquakes have underscored the significance of working from home in ensuring business continuity in situations where commuting to the workplace becomes impracticable. This thesis initially highlights that working from home is considered a new normal work model, and provides general information on this matter. Working from home is subsequently examined from the perspective of individual labor law, encompassing the elements, regulation, rights and obligations of the parties involved, as well as termination considerations related to working from home.
