Abstract (EN)

In Turkey, investments in the public construction sector are carried out through tenders via the Electronic Public Procurement Platform (EKAP). At this stage, various tender and contract methods are determined, and public investments are executed accordingly. In the construction sector—which should be considered as a whole—it is a fact that all projects considered as public investments are deeply intertwined with the private sector and go through the project process together. However, during the project, various issues arise due to factors such as economic risks, improper or inconsistent implementation of legal provisions, and the inadequacy of sector stakeholders, leading to unnecessary expenditures of public resources. In this context, particularly for construction works, problems are encountered starting from the determination of the type of contract, continuing through both the preparation and implementation stages, and even after project completion. Although there are numerous legal regulations on these matters in our country, it has been observed that due to their fragmented nature, they are not sufficiently known or understood. Within this scope, problems that may arise during project processes have been identified, and solutions have been sought to prevent such problems from occurring in the first place. While identifying the problems and proposing solutions, theoretical facts, legal provisions, and sectoral practices were all taken into account, and suggestions were made for resolving disputes. Official unit prices and rules were questioned in terms of how realistic they are. Concepts such as contract, estimated cost, risk, and price differences were emphasized, and the opinions of individuals holding various positions in the sector were gathered through face-to-face surveys. Risks regarding economic and occupational safety aspects were identified, and statistical evaluations were made comparatively using data from the Turkish Statistical Institute (TÜİK) and the Social Security Institution (SGK).
